TERMS OF SERVICE

1. Who Can Play

If you are under the age of majority where you live, you may use the Game only with the permission of a parent or guardian, who agrees to these Terms on your behalf and is responsible for any purchases you make.

2. Your Account

You can play as a guest or sign in to save your progress across devices. You are responsible for keeping your sign-in details safe and for everything that happens under your account. Your username may appear on public leaderboards, so it must not be offensive, impersonate someone else, or contain personal information. We may change or remove usernames that break this rule.

3. Sparks and In-App Purchases

• Virtual items only: "Sparks", characters, upgrades and other in-game items are virtual. You get a limited, personal licence to use them in the Game. They have no real-world value, are not your property, and cannot be exchanged for money, sold, or moved to another account.
• Purchases: Purchases are made through the Apple App Store or Google Play and are also subject to their terms. Buying Sparks with real money requires an account. Prices are shown in the store before you buy.
• Refunds: Except where the law requires otherwise, purchases are final. Refund requests are handled by Apple or Google under their own refund policies.
• Game updates: We may change prices, rewards and how in-game items work as we update the Game.

4. Advertising

The Game shows advertisements, including optional rewarded video ads that give you in-game rewards. Ads are provided by Google AdMob. How ad data is handled is described in our Privacy Policy.

5. Fair Play

When using the Game, you agree not to:

• Cheat, or use hacks, bots, modified game files or other tools to change scores, Sparks or progress.
• Exploit bugs for an unfair advantage, or interfere with the leaderboards or our servers.
• Copy, reverse engineer, resell or redistribute the Game, except where the law allows it.
• Use the Game for anything unlawful.

If you break these rules, we may remove scores or in-game items, or suspend or delete your account.

6. Ownership

The Game, including its characters, artwork, music, code and name, belongs to CNEP Studio and is protected by copyright and other laws. These Terms give you a personal, non-exclusive, non-transferable licence to play the Game on devices you own or control, for your own non-commercial use.

7. Changes and Availability

We update the Game from time to time and may add, change or remove features, characters, events or content. We try to keep the Game running, but we can't promise it will always be available or free of errors, and we may stop offering it in the future.

8. Deleting Your Account

You can stop playing at any time, and delete your account from the Game settings or as described in our Privacy Policy. Deleting your account permanently erases your progress, Sparks and unlocked characters, including purchased ones, and they cannot be restored or refunded.

9. Disclaimers and Liability

The Game is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, and we are not liable for any indirect, incidental or consequential damages, or for any loss of data or virtual items, arising from your use of the Game. Our total liability to you is limited to the amount you paid for the Game and in-app purchases in the 12 months before the claim. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived, including the consumer guarantees under the Australian Consumer Law.

10. Changes to These Terms

We may update these Terms. When we do, we will change the "Last updated" date above. If you keep playing after an update, you accept the new Terms.

11. Governing Law

These Terms are governed by the laws of Australia. Any dispute about these Terms or the Game will be handled by the courts of Australia, unless the law where you live gives you the right to bring it in your local courts.
